This Privacy Policy explains how HARVINAADHI INTERNATIONAL PRIVATE LIMITED ("we", "us", "our") collects, uses, shares and protects your personal data when you visit or buy from TheBATALhub (also written HAIL's TheBATALhub) at thebatalhub.in, or contact us about it.

Who we are

TheBATALhub sells made-to-order (print-on-demand) apparel in India, such as t-shirts, raglan tees, kids tees and a maternity dress. Under the Digital Personal Data Protection Act, 2023 (DPDP Act), we are the "Data Fiduciary", which means we decide why and how your personal data is used. Our business address is at Brindavan Colony, Hydernagar, 500090, Hyderabad TS, India.

This policy follows Indian law, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the DPDP Act.

What we collect

  • Order and delivery details. Your name, email address, phone number, billing and delivery address, and the items you order.
  • Payment information. Payments are handled by payment processors at Shopify checkout. They collect your payment details directly. We receive the payment status and limited details about the payment, such as the payment method, along with the order details we need to manage your order.
  • Account details. If you create an optional customer account, the details you use for it and your order history.
  • Messages. What you send us through the contact form, WhatsApp or email, including any photos or videos you share for a defective, wrong or damaged item.
  • Newsletter. Your email address, if you sign up for our email newsletter.
  • Device and usage data. Information collected through cookies and similar tools, such as your IP address, browser and device type, and the pages you view. Shopify and other tools we use collect this for us.

Giving us this information is your choice, but we cannot process an order without the details it needs.

Why we use your data

  • To fulfil your order. To have your item printed, shipped and delivered, and to send order updates.
  • To support you. To answer your questions and handle reports of defective, wrong or damaged items, replacements and refunds.
  • To run and protect the store. To keep it secure, prevent fraud, and understand and improve how it is used.
  • To meet legal duties. For example tax and accounting records, and replying to lawful requests from authorities.
  • To send marketing, only with your consent. For example our newsletter. You can opt out at any time.
  • To measure and show advertising, where enabled. With your consent where the law requires it.

We use your data with your consent, or for purposes the DPDP Act allows without consent, such as completing an order you asked for or meeting a legal obligation.

Who we share your data with

We share your data with the following, and only for the purposes described in this policy:

  • Shopify, which hosts our store, cart and checkout.
  • Payment processors, who process your payment at checkout.
  • Fulfilment and print partners and couriers. Every item is printed after you order, so third-party print and fulfilment partners, and the couriers they use, receive what is needed to make and deliver your order, such as your name, delivery address, phone number and the items ordered.
  • Analytics and advertising channels, where enabled. These can include Facebook, Instagram and Pinterest, where we list products on them. Depending on how they are set up, and with your consent where the law requires it, they may receive information about your visits and purchases to measure results and show ads. You can withdraw that consent at any time by contacting us using the details below or by blocking cookies in your browser.
  • Legal authorities, when the law, a court order or a lawful request requires it, or when needed to prevent fraud or protect our rights.

These companies have their own privacy policies. Shopify and some partners may store or process data on servers outside India, as permitted by Indian law.

Cookies

We use cookies and similar tools to keep your cart working, remember your preferences, run analytics and, where enabled, measure advertising. Shopify, which runs our store, sets some of these cookies. You can remove or block cookies in your browser, but the cart and checkout may then not work properly. To opt out of data sharing, contact us using the details below and we will act on your request.

How long we keep your data

We keep your personal data for as long as needed for the purposes described in this policy, or as required by law. For example, order and payment records may need to be kept for tax and accounting reasons.

Security

We use reasonable safeguards to protect your data. No website or system is 100% secure, so we cannot promise absolute security. Please do not send card details over WhatsApp, email or the contact form, and keep any account login private.

Your rights

Under the DPDP Act, 2023, as its provisions come into force and subject to its conditions, you can:

  • Access. Ask for a summary of the personal data we process about you and who we share it with.
  • Correction. Ask us to correct inaccurate, incomplete or out-of-date data.
  • Erasure. Ask us to delete your data. We may keep what we must for legal reasons or to complete an order in progress.
  • Withdraw consent. Withdraw your consent at any time. To stop marketing emails, tell us using the contact details below.
  • Nominate. Nominate another person to exercise your rights for you if you die or cannot do so yourself.
  • Grievance. Raise a complaint about how we handle your data with our Grievance Officer, below.

To use any of these rights, email or message us on WhatsApp using the contact details below. Please use the email address or phone number you gave us, so we can confirm it is you. If you are not satisfied with our reply, you may approach the Data Protection Board of India where the DPDP Act allows.

Children

TheBATALhub is not directed to anyone under 18. We sell kids tees, but they are meant to be bought by parents and guardians, so please ask one to place orders for you. If you believe a child has given us personal data without a guardian's consent, contact us and we will delete it.

Links to other websites

Our store may link to other sites and platforms, such as WhatsApp and Instagram. We do not control them and are not responsible for their content or privacy practices. Please read their policies before sharing your data.

Changes to this policy

We may update this policy when our practices or the law change. We will post the new version here and update the "Last updated" date. If a change materially affects how we use your personal data, we will tell you and ask for your consent again where the law requires it.

In line with the Consumer Protection (E-Commerce) Rules, 2020, we acknowledge complaints within 48 hours of receiving them and redress them within one month of receiving them.

This policy is governed by the laws of India, and the courts at Hyderabad, Telangana have jurisdiction, subject to any rights you have under applicable law, including your right as a consumer to bring a complaint before the consumer commission where you live or work.
